Drink Driving Penaltys

For a first time offence:

  • less than .05% loss of licence of 3 - 12 months
  • between .05% to less than .1% loss of licence of 3 - 12 months
  • between.1% to less than .15% loss of licence of 6 - 18 months
  • over .15% loss of licence of 12 - 36 months

For a second time offence

  • less than .05% loss of licence of 6 - 24 months
  • between .05% to less than .1% loss of licence of 6 - 24 months
  • between.1% to less than .15% loss of licence of 12 - 36 months
  • over .15% loss of licence of 24 - 72 months

Drug Driving offences

  • loss of licence of up to 3 years

In addition to the loss of licence, the court has the power to impose fines and impose actual imprisonment upon offenders. Imprisonment is unlikely for first time offenders where no other persons or property are injured and the reading is not a high range reading

What can I do to minimise my penalty?

The material that you put before a Court to mitigate your sentence is critical to minimising the penalty that is imposed upon you. Things such as character references, evidence of financial hardship and objective evidence of your responsibilities for your family are all things that should be considered to be put before the Court.
