Did you know that in a Workers Compensation case, the insurer doesn’t pay your legal costs.

Generally, if you receive an amount of workers compensation, you then go backwards with everything that comes out of your lump sum. Therefore the amount you pay in legal costs is absolutely critical in determining what you receive in your hand from your settlement.

In Queensland, personal injury lawyers are entitled to charge up to 50% of the injured works compensation.

The setting of a maximum fee is particularly effective for people who are badly injured in the workplace. Below is an example:

Example

An injured worker receives a workers compensation payment of $200,000.

Bold Lawyers charge the worker $20,000 in legal fees, plus GST ($2,000), plus the cost of medico-legal reports $3,000 and a Centrelink refund of $5,000. The Worker receives a payment of $170,000 in the hand.

A law firm that charges up to 50% of your legal fees (which includes your outlays and government charges) could result in the injured person receiving $100,000.00 in the hand.

In the above example, the injured worker will receive $70,000 more in the hand from BOLD LAWYERS.

What happens if my workers compensation claim settles for a small amount?

Sometimes workers compensation claims may not result in large payments of compensation. There can be a variety of reasons including that the accident was not the employers fault, the injured persons injury may not be that serious or the injury has not caused the injured worker to miss out on employment. BOLD Lawyers maximum fee of $20,000 plus GST plus outlays will still apply in small cases, however it is the firm’s policy to NEVER charge a claimant 50% of their damages. An example is as follows:

The injured workers claim settles for $20,000.BOLD LAWYERS have spent $3,000 on medico-legal reports, leaving a lump sum of $17,000.In this example, BOLD LAWYERS would not charge more than $5,000 plus GST to insure that the injured person receives more than $10,000 in the hand.
